Law a little gray on HOA ability to ban marijuana (CO)

Twice in recent weeks, I’ve been asked informally whether an owners association can regulate the possession, use and/or cultivation of marijuana. On both occasions, my response was: “Wow, that’s a really good question. I don’t have a clue.” I have, however, decided as a matter of professional pride that I should be able to do better than this.
