Long Beach (IN) property line decision now in judge’s hands

Following oral arguments in a summary judgment hearing in La Porte County Superior Court No. 2 on Wednesday, Judge Richard Stalbrink now has up to 90 days to make a decision in the Long Beach property line dispute.  This is the second lawsuit filed by plaintiffs Long Beach Lakefront Homeowners Association, Don Gunderson and Margaret West, who together argue the northern boundary of private lakefront properties is the water’s edge of Lake Michigan.  In December 2013, in the first lawsuit, La Porte County Circuit Court Judge Thomas Alevizos ruled against the lakefront homeowners citing court case United States v. Carstens, which said, “According to the Indiana ‘public trust doctrine,’ the beach area between the ordinary high water mark (OHWM) and the edge of the water of Lake Michigan is public land and not owned by any person, entity or municipality.”   Read the article………..
