Micronesia: Court dismisses Anaks lawsuit

SUPERIOR Court Presiding Judge Robert Naraja has dismissed the lawsuit filed by Anaks Investors LLC or ANI owned by Allan Perez against the Anaks Ocean View Hill Saipan Homeowners Association.  Judge Naraja in his ruling stated that 1) ANI lacks authority to bring an implied constitutional cause of action under Article XII; and 2) even if ANI were allowed to bring an implied constitutional cause of action under Article XII the statute of limitations has run out.  ANI, in its lawsuit, wanted the court to declare that the homeowners association’s right of first refusal is invalid pursuant to Article XII of the Commonwealth Constitution which states that only persons of Northern Marianas descent can own land in the CNMI.  ANI has expressed interest in Anaks Ocean View Hill, a condominium-style residential development which consists of 131 residential units plus common areas.    Read the article………….
