Survey Work Could Shed Light On Beach Dispute (MA)

The long-simmering right of way dispute came into sharp focus earlier this summer when residents living in a condominium association of seaside houses and cottages blocked a longstanding right of way, known as White Cap Path, with a five-foot pile of sand and snow fencing.   The blockade enraged residents of neighborhoods near the beach who maintain they have a deeded right of way over the land from White Cap Path to the ocean. They point to a 1963 decree from Barnstable Superior Court that spells out their right to traverse the path to the public beach.    Read the article…………….
