  • Class-action case challenges POA actions (AR)
    A class-action complaint filed Tuesday afternoon in Saline County Circuit Court alleges that the Hot Springs Village Property Owners’ Association has violated the Declaration in real-estate matters.  The suit, Jeffery Atkins et al v. Hot Springs Village POA, is case 63CV-24-477. In an emailed statement, the plaintiffs said: “It is our opinion that the POA Board and Management has lost its way and we intend to fix it. We’ve taken this action to protect the interest of all property owners and ask the Courts to preserve the integrity of the governing documents.”    Read the article…………………………….

  • North Little Rock neighborhood eyes monthly fee to renovate pool, facilities (AR)
    Established by the developers of North Little Rock’s Indian Hills subdivision in 1965, the Indian Hills Community Club owns the Indian Hills pool and tennis courts at 39 Coronado Circle, as well as the two lakes located between Pontiac Drive, Osage Drive, Flintrock Road and Coronado Circle.  After operating on voluntary dues and volunteer management for almost 60 years, the facilities are in need of major restoration that exceeds the community club’s ability to fund.    Read the article………………………..

  • Disbanding police force shocks Diamondhead residents (AR)
    Diamondhead residents were surprised to learn their police department ceased to exist as of Jan. 13.  The email the property owners association sent that same day informed POA members the department had been disbanded, and that security for the gated community would be outsourced to a private contractor. The email said maintaining a police force was no longer financially feasible, but many residents found the explanation lacking.   Read the article………………………..

    This statutory provision provides certain exemptions from the Clean Water Act National Pollutant Discharge Elimination System (“NPDES”) or state permits for nonmunicipal domestic sewage treatment works. The legislation would add (vi) to the exemptions from (C): (vi) A property owners’ association or homeowners’ association that operates a nonmunicipal domestic sewage treatment works that services a population exceeding five thousand (5,000) individuals.   Read the article………………………..
  • Changes in Arkansas Law 2021
    Act 253 allows Arkansas corporations to hold annual or special shareholder meetings through remote communication and requires guidelines and procedures governing remote shareholders’ meetings. It also provides verified shareholders and proxy holders who are not physically present at a shareholders’ meeting to have a reasonable opportunity to participate in the meeting, be deemed present at the meeting, and be permitted to vote on matters submitted at the meeting.

    The Arkansas Pollution Control and Ecology Commission (“Commission”) addressed at its January 24th meeting a request by the Bella Vista Property Owners Association (“POA”) that it conduct an adjudicatory hearing to review the Consent Administrative Order (“CAO”) issued by the Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) in the matter of Thomas Fredericks and Fredericks Construction Company, Inc.
