Australia: NCAT’s Dispute Resolution Power – How far does it go?

This has been vexed question over the last 2 years with many different decisions.  In respect of the power to issue an order for damages against and owners corporation for failing to repair and maintain common property, the Court of Appeal has found that the Tribunal had such power in the matter of Vickery v The Owners – Strata Plan No 80412 [2020] NSWCA 284 as explained below.
