FCC Continues to Undercut Local Authority on OTARD

The FCC’s over-the-air reception devices (known as OTARD) rules (47 C.F.R. §1.4000) limit local governments’, homeowner associations’ and condominium boards’ oversight authority over certain antennas and satellite dishes for certain size specifications. In the Primary Purpose Report and Order released on Jan. 7, the FCC expanded its rules to eliminate the primary purpose test used to justify the deployment of an OTARD.   Read the article…………………………………
