The First District Court of Appeals in San Francisco will hear oral arguments next week in the case of Casa Mira Homeowners’ Association v. California Coastal Commission. At issue in the case is the effort by owners of condominiums overlooking Miramar Beach to build a sea wall to protect structures that were damaged in storms back in after storms in 2016. The owners obtained an emergency permit to place boulders in front of the building to form riprap that protects the building, but the Coastal Commission denied subsequent applications to build a concrete sea wall, saying that because Casa Mira was built in 1984 it is not exempt from the Coastal Act.
