The homeowners association at the Reserve filed suit against the developer this month, another step in the decline of the would-be exclusive development on the Erie Canal in Brighton. As the Democrat and Chronicle reported in October, the ambitious $180 million, 327-unit development has floundered after the death of developer Anthony Costello in March 2016. His family company, now headed by his son Brett Costello, is in arrears on taxes and faces legal challenges on several fronts, including foreclosure of some property and an investigation from the state Attorney General’s office.
