Lake lawsuit order filed

On Friday, Aug. 29, District Court Judge Margaret Marrinan issued an order in the lake level lawsuit denying all of the parties’ requests for summary judgment with one exception. Intervenor White Bear Lake Homeowners’ Association’s motion on whether the public trust doctrine allows a common law cause of action to protect the public’s use rights to the lake was granted. The judge concluded that the water in the lakebed is a public trust asset, but whether defendants’ management of water appropriation permits or use actually violated its duty to the public is still yet to be addressed.      Read more………
