Prior to the legalization of recreational marijuana in Canada later this year, condominium corporations should be reviewing their declaration and rules to ensure that they contain provisions that will allow the corporation to regulate the use and cultivation of marijuana on the condominium property. The new federal legislation, which is expected to come into force on July 1, 2018, will not only allow the recreational use of marijuana, but will also permit the cultivation of marijuana plants for personal use.
