The 2,000-foot-deep well is in the middle of a residential neighborhood, which is subject to the rules established by a homeowners association. Those rules would normally preclude business uses, like a well, storage tank and distribution system. The judge ruled that the larger interest of the community justifies putting the well in a residential neighborhood. However, he also said that the district has to go through the formal eminent domain process to justify bypassing the restrictions in the homeowners association CC&Rs, according to the district’s statement.
