The increasing involvement of the Texas Legislature over the last few legislative sessions is forcing property owners associations (“POA”) to consider new approaches to governance. This is brought on by new laws and the unlikelihood of POAs being able to achieve the owner vote requirements to amend their governing documents. As a result, to ensure their governing documents comply with the new laws, POAs are turning to or adding an additional layer to their documents in the form of policies.
