  • 94th Arkansas General Assembly/NPDES Permits: Property/Homeowner Associations Exemptions
    This statutory provision provides certain exemptions from the Clean Water Act National Pollutant Discharge Elimination System (“NPDES”) or state permits for nonmunicipal domestic sewage treatment works. The legislation would add (vi) to the exemptions from (C): (vi) A property owners’ association or homeowners’ association that operates a nonmunicipal domestic sewage treatment works that services a population exceeding five thousand (5,000) individuals.   Read the article………………………..
  • Changes in Arkansas Law 2021
    Act 253 allows Arkansas corporations to hold annual or special shareholder meetings through remote communication and requires guidelines and procedures governing remote shareholders’ meetings. It also provides verified shareholders and proxy holders who are not physically present at a shareholders’ meeting to have a reasonable opportunity to participate in the meeting, be deemed present at the meeting, and be permitted to vote on matters submitted at the meeting.

    The Arkansas Pollution Control and Ecology Commission (“Commission”) addressed at its January 24th meeting a request by the Bella Vista Property Owners Association (“POA”) that it conduct an adjudicatory hearing to review the Consent Administrative Order (“CAO”) issued by the Arkansas Department of Energy and Environment – Division of Environmental Quality (“DEQ”) in the matter of Thomas Fredericks and Fredericks Construction Company, Inc.
