McKeddie Cooley was recently published in an Arizona Court of Appeals special action decision that clarified when and how a party must request attorneys’ fees on appeal. The case, Halt v. Hon J. Richard Gama, clarified the requirements of Arizona Rules of Civil Appellate Procedure 21. In reaching its decision, the Court of Appeals vacated a homeowners’ association’s judgment that contained an award of over one hundred thousand dollars in attorneys’ fees and costs against homeowners.
