Sam Weiner and Faye Ran are shareholders at the 451 West Broadway Cooperative in Soho. Weiner resides in the apartment directly above Ran. Ran alleges that, on November 5, 2011, a leak in Weiner’s apartment caused the ceiling to collapse in her apartment. There was significant damage to the apartment and her personal property – roughly $27,000 beyond what her insurance carrier would reimburse, she said. When Weiner refused to pay, Ran sued him, claiming that he was required to reimburse her under the cooperative’s house rules.
